Our skilled professionals will initiate personal contact with the delinquent homeowner to open the dialogue regarding the debt and notify the Association’s decision to proceed with a lawsuit against them. All clients are treated with the utmost respect.
Most times we find that homeowners want to cure the debt and unaware of the options. If the homeowner is non-responsive to our initial contact (USPS First Class Mail and Certified Mail, phone & email if applicable); we move forward with the lawsuit and arrange for personal service of the court appearance summons.
Upon submittal of the executed Small Claims Court Agreement, UTS will prepare and file all necessary documents with the court. By utilizing the Small Claims Court process, UTS is increasing the ability to remedy the Association’s delinquent balance quickly and successfully.
A Court Judgment stays on the homeowner’s credit for up to ten years (once recorded by the Association).
