There are three common types of bankruptcy named for their respective chapters in the United State Bankruptcy Code.

Chapter 7 – Also known as “liquidation” or “straight bankruptcy”. The most common filed bankruptcy. Essentially allows the debtor to make a fresh start. Proof of Claim cannot always be filed and can be striped.

Chapter 11 – Reorganization. Primarily applies to commercial enterprises that wish to continue business operations while repaying creditors through a court-approved reorganization plan.

Chapter 13 – Adjustment of Debts of an Individual with Regular Income. Designed for an individual who has a regular source of income, a desire to pay his or her debts, but currently is unable to do so. Under this chapter, usually allows the debtor to keep an asset, such as the house.
